It may be recalled that the moment Yeddiyurappa sought and got the support of six MLAs elected as "IndependentMLAS", they are disqualified and his govt. is invalid at law. Itwas the onerousresponsibility of the Speaker to uphold the constitution as regards "defection of MLAs".He should have declared the six independent MLAs who joined the BJP as "disqualified".Hence, on 9th October, he is precluded from avaiingl the disqualification law aginst them!
